MyEChart Terms and Conditions


The Elliot Health System (“EHS”) patient portal (hereinafter “MyEChart”) is a service designed to (1) provide patients with Web-based access to portions of their medical records, (2) allow patients to communicate with staff through secure email and (3) offer parents, guardians, or other individuals concerned about the patient, proxy access to the patient's MyEChart account. For the following outlined Terms and Conditions, the words “you” and “your” shall refer to the individual accessing the MyEChart service. The words “us”, “we” or “our” shall refer to EHS.

By accessing or using MyEChart, you agree to be bound by the following “Terms and Conditions”. If you do not wish to be bound by these Terms and Conditions, you may not access or use MyEChart. We may modify these Terms and Conditions at any time, and such modification shall be effective once posted.

By clicking the “Accept” button you are agreeing to follow these Terms and Conditions and are indicating that you have read and fully understand these Terms and Conditions, therefore creating an electronic signature of acceptance.

We reserve the right to suspend or terminate access to MyEChart at any time and for any reason. If you have any questions about these Terms and Conditions, please contact the MyEChart Customer Support Team at M3@Elliot-hs.org.

I. General Provisions


1. EHS offers the MyEChart service as a convenience to patients. EHS assumes no responsibility for how you use the information you obtain from MyEChart or who you share your username and password to MyEChart with. MyEChart is not a substitute for appropriate and timely contact with your health care provider. You should never change or stop any course of treatment prescribed by your health care provider without first consulting him or her.

2. You should not use the MyEChart service if you have any emergency or think you need to speak to someone urgently. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD CALL 911 OR GO TO THE EMERGENCY DEPARTMENT OF YOUR LOCAL HOSPITAL.

3. Supplying an Email Address. You agree to register for MyEChart with a valid, current email address. If you change your email address, it is your responsibility to update MyEChart with the new email address.

4. EHS makes every effort to keep your health information secure and confidential. You also agree to do the following things to help keep your information secure:

You will keep your username and password secure. When you register for MyEChart, you will create a username and a confidential password. EHS will treat anyone who uses your username and password as "you" and that individual will have access to all the information in your MyEChart record. Therefore, you are responsible for maintaining your username and password in strict confidence. In no event shall you share your username or password with any third party or allow another person to access MyEChart using your username or password. You shall notify EHS immediately if you suspect that someone is using your password in an inappropriate manner.

You will never be asked for your MyEChart username and password in an email. Please do not respond to any emails that ask for this information. If you have already responded to such an email, change your password right away and contact the MyEChart Customer Support Team at M3@Elliot-hs.org.

Email Notifications. You will be notified via email when there is new medical information to be viewed through your MyEChart account. Any person with access to your email will be able to see this notification. Although no private medical information is contained within the email notification, you may not want others to know. It is your responsibility to manage who has access to your personal email address.

5. EHS does not guarantee that you will be able to access MyEChart or, its availability at all times.

6. Confidentiality and Security. The privacy of MyEChart users’ health care information is protected by state and federal laws, including the Health Insurance Portability and Accountability Act (“HIPAA”). If you have questions or want to learn more about the privacy and security of your protected health information at EHS, please refer to EHS’s Notice of Privacy Practices (https://www.elliothospital.org/website/downloads/Privacy-Practices-2018.pdf).

7. Push Notification for the MyEChart Mobile App. If you download the mobile MyEChart application on your personal mobile device, when you have new information to view in MyEChart, such as a message from your doctor or a test result, you have the option to be notified in real-time with ‘push notifications’ on your mobile device. If you do not want to receive push notifications, you can configure the notification settings on your mobile device, similar to other mobile applications, to no longer receive push notifications.

II. MyEChart Communications


1. Information submitted through MyEChart will become part of your EHS medical record. Email messages that you send through MyEChart will be routed to the appropriate department, and EHS or EHS affiliated staff, other than your healthcare provider, may review your message if appropriate based on their job functions.

2. You agree to read your MyEChart messages regularly. The messages you receive through MyEChart may contain important information.

3. You should not send messages requiring immediate attention through MyEChart. We will make reasonable efforts to be as responsive as possible to MyEChart messages. However, delays may occur based upon message volume, availability of staff, the complexity of the patient’s condition, or technology disruptions. Therefore, we cannot guarantee how long it will take us to respond to these messages and you should allow up to 2 business days for a response. EHS is only able to respond to electronic communications based on the information provided by you. If there is insufficient information provided, we will be unable to provide a reliable or accurate response.

4. Prohibited Uses of MyEChart. You agree that you will not upload or transmit any communications or content of any type (including secure messaging) that may infringe upon, misappropriate or violate any rights of any party and that your use of MyEChart will not include any of the following:

• Signing on as or pretending to be another person;
• Transmitting messages or material that infringes on or violates the intellectual property rights of others or the privacy or publicity rights of others;
• Transmitting material or content in any form or media, including email or other electronic communication that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including EHS personnel) or entity;
• Using MyEChart’s interactive services in any way that is intended or is reasonably likely to harm the patient or others; or
• Intentionally distributing viruses or other harmful computer code.

III. Medical Record Data


1. The MyEChart service provides online access to portions of your EHS electronic record. Not all of your EHS medical record may appear on your MyEChart record. Posting of information is at the discretion of your individual provider(s) and EHS.

2. Your health care provider(s) will maintain and update your electronic medical record at each office visit. However, if you believe any information displayed in MyEChart is not accurate, you are encouraged to notify your health care provider at your next appointment or by calling your provider’s office.

IV. Proxy MyEChart Access


1. Children
Parents or legal guardians of children ages 0-11 can have full access to their child’s record in MyEChart by filling out and submitting the MyEChart Parent/Guardian Access Form. Once the child turns 12, your access will automatically terminate and you will need to sign a new form for new limited access. Parents or guardians of children 12-17 years of age can have limited access to the child’s MyEChart account. Once the child turns 18, your access will automatically terminate. Please refer to the MyEChart FAQ for additional information. The patient may also request a personal MyEChart account.

2. Adult Patients (18+)
Individuals age 18 or older may request proxy access to another individual’s MyEChart account by filling out and submitting the MyEChart Proxy form. The person whose chart you need to access must consent to your access by completing the MyEChart Patient Authorization Form. Access to another adult’s account is good for one year, at which time your access will terminate. EHS reserves the right to revoke proxy access at any time.

V. Limited License


Subject to the Terms and Conditions contained herein, EHS grants you a limited license to access and use MyEChart. This license is for your personal use only and may not be shared with or transferred or sublicensed to any other party.

VI. Limitation of Liability; Waiver and Release


YOU AGREE THAT NEITHER WE, NOR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU UNDER ANY THEORY OF LIABILITY OR INDEMNITY IN CONNECTION WITH YOUR USE OF MYECHART. YOU HEREBY RELEASE AND FOREVER WAIVER ANY AND ALL CLAIMS YOU MAY HAVE AGAINST US, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS OR SUPPLIERS (INCLUDING BUT NOT LIMITED TO CLAIMS BASED UPON OUR NEGLIGENCE, OR THE NEGLIGENCE OF OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTENT PROVIDERS, OR SUPPLIERS) FOR LOSSES OR DAMAGES YOU SUSTAIN IN CONNECTION WITH YOUR USE OF MYECHART.
